Cancellation and Refund Agreement

CONTRACT PRICE PRICE INCREASE

In the event of a price increase in the contract price, the difference will not be requested from the consumer, and the discounts called as action by the facility will not be refunded to the consumer. However, for package tours abroad where the contract price is determined in foreign currency, in the event of an extraordinary increase in the exchange rate, changes in taxes, duties, fees and similar legal obligations collected in places such as ports, airports, and in the event of an extraordinary increase in transportation costs, including fuel costs (a price increase of more than 2% will be considered as an extraordinary increase), the Consumer has accepted that hammammia.com has the right to make changes in prices and conditions, not exceeding 5% of the contract price.



SERVICE TRANSFER

In the event that it is not possible for the consumer to continue the purchased tour/accommodation/service, the consumer may transfer the reservation to a third party who will fulfill all the conditions applicable to the contract by notifying hammammia.com at least 7 days before the departure date. In this case, the person(s) transferring the contract and the transferee(s) are jointly and severally liable to hammammia.com for the balance amount and the payment of all additional costs arising from the transfer in question. For tours with air transportation, this situation is evaluated in accordance with the cancellation and change conditions of the carrier airline company. Especially in international tours, the visa fees of consumers whose visa procedures have been completed for the transferred tours are not refundable. Consumers who take over the package tour will be responsible for their own visa responsibilities. In the event that consumers do not have a visa, although they have applied, they cannot obtain a visa from the relevant institution until the tour start date, hammammia.com does not accept responsibility and collects the entire tour price from the transferor and transferee (jointly). In case the person who transfers the service does not have the same status as the transferor, the transfer is not realized or the transfer is completed by removing the special discounts made.



AMENDMENT RIGHTS

Before the start of the package tour / service, significant changes in the content of the contract due to reasons not caused by the Consumer and other price etc. changes other than the price and changes made for the reasons specified in Article 5 are accepted as material contract changes. Material contractual changes and the effect of such material contractual changes on the price shall be immediately notified to the Consumer/Participant by hammammia.com in writing and/or via a permanent data storage device. The Consumer/Participant may accept the change notified in writing or via permanent data storage immediately after the notification is made to him/her, provided that he/she notifies hammammia.com in writing or via permanent data storage that he/she does not accept the change made;

a. Participation in another package tour of equal or higher value offered by hammammia.com without any additional payment,

b. Participation in a package tour of a lower value, provided that the price difference is refunded,

c. To rescind the contract without paying any compensation.

In case of withdrawal from the contract by the Consumer / Participant, the price paid by the Participant / Consumer shall be returned to the Consumer / Participant without any deduction within 14 days at the latest from the date of receipt of the notice of withdrawal from the contract by hammammia.com. Although the Participant / Consumer has been notified by hammammia.com of the fundamental contract changes and the effect of these fundamental contract changes on the price in the above procedures, if the Consumer / Participant does not give any response to the notification and / or does not notify hammammia.com through the above-mentioned procedures, the Consumer/Participant agrees and declares that he/she will be deemed to have accepted the new conditions in the form of this additional contract, which contains the essential changes in the package tour contract, including the price increases notified to him/her, and that if he/she does not participate in the tour without any notification, the Consumer cannot claim the refund or compensation of the fees on the grounds that he/she has not received the service, and that the fees he/she has paid are compensation for withdrawal. If hammammia.com cancels the tour / contract before the start of the tour / service for a reason not caused by the Consumer / Participant, the Consumer / Participant may use the rights listed in paragraphs a), b) and c) above and granted to the Consumer / Participant.



NON-START AND NON-CONTINUATION OF SERVICE

Although hammammia.com has taken all necessary care, if the tour / service cannot be started for the reasons stated below or if the continuation of the tour becomes impossible for the reasons stated below and/or if the breach of the contract is caused by the reasons stated below, hammammia.com cannot be held responsible for the failure to perform the contract at all or as required;

a. Fault of the consumer.

b. An unexpected and unforeseeable behavior of a third party not involved in the performance of the contract.

c. The existence of force majeure.

d. The occurrence of an event that the package tour organizer, intermediary or independent service provider could not foresee or prevent despite exercising all due care,

e. The cancellation of the package tour due to the failure to meet the minimum participation foreseen for the organization of the package tour and the cancellation has been notified to the Consumer in writing or by permanent data storage at least twenty days before the start of the package tour within the period stipulated in the contract (If the reason for postponement and / or cancellation of the tour occurs less than 20 days before the start of the tour, hammammia.com cannot be held responsible for this).

In the event that the above-mentioned reasons arise before the tour starts, hammammia.com has the right to cancel and/or postpone the tour / service or offer an alternative tour by informing the Consumer in writing or by Permanent Data Storage. If the tour cannot be started for the reasons stated above and the consumer does not accept to postpone the tour or participate in the alternative tour, hammammia.com shall cancel the tour of the Consumer. In this case, if the Consumer does not accept hammammia.com's postponement request or alternative tour offer or if it is actually impossible to postpone the tour, hammammia.com shall refund the payments made by the Consumer until that date to the Consumer, except for the official payments (taxes, fees, etc.) made for the Consumer. If force majeure occurs after the start of the tour, during the performance of the service, hammammia.com's responsibility is to bring the Consumer back to the starting point of the tour and no other responsibility (refund, compensation, etc.) can be imposed on hammammia.com.



CANCELLATION AND REFUND TERMS

In case of cancellations made by the consumer up to 30 days before the start of the service without giving any reason, the price paid by the consumer shall be refunded to the consumer, except for the costs arising from compulsory taxes, fees and similar legal obligations to be paid and the costs paid to third parties that can be documented and cannot be refunded. For cancellations made by the consumer between 29 and 15 days before the start of the service, the consumer declares, accepts and undertakes to pay 35% of the reservation fee, and for cancellations made less than 14 days before the start of the service, the consumer declares, accepts and undertakes to pay the entire reservation fee to hammammia.com. For cancellations made up to 60 days before the start of the service in special products of the consumer, the consumer will be refunded the full amount of the fee paid until that moment. The consumer declares, accepts and undertakes to pay hammammia.com 25% of the reservation fee if he/she cancels the contract 59-31 days before the start of the service, 50% of the tour fee if he/she cancels the contract 30-15 days before, 75% of the trip fee if he/she cancels the contract 14-07 days before, and all of it less than 7 days before. If the service purchased is a product within special periods such as New Year, semester, holiday period or other campaigns, the above articles of the contract are not valid. In this case, the consumer has no right to cancel or refund. Consumer(s) who have early booking cancellation insurance for domestic accommodation and early booking cancellation assurance package for cultural tours can use the right of uninterrupted cancellation 72 hours before the start of the service. The consumer's early booking cancellation insurance or early booking assurance package does not cover air transportation costs. In the case of cancellations of international trips, if a visa has been obtained, the visa fee cannot be refunded. In tours with air transportation, in the cancellation request of the consumer, this situation is evaluated in accordance with the cancellation and change conditions of the carrier airline company. In case of the consumer's request to change the service, provided that this change is approved by hammammia.com, if there is a price difference between the service previously received and the new service requested, the consumer must immediately pay the difference to hammammia.com upon acceptance of the change request. However, if the price of the new service is lower than the previous service price, hammammia.com shall refund the difference to the consumer.



FORCE MAJEURE

In the event that the Consumer notifies less than 30 days before the start of the tour / service due to a situation or force majeure that he / she cannot foresee or prevent, despite taking all necessary care, the price paid by the Consumer shall be refunded to him / her, except for the costs arising from legal obligations such as taxes, fees, etc. and the costs that can be paid to third parties and documented and non-refundable. If it occurs during the continuation of the tour, the information and documents related to this should be submitted to hammammia.com immediately after the consumer leaves the tour. In the event that the consumer does not notify in writing that he / she will participate in the tour / accommodation / service that he / she missed the start; hammammia.com has the right to cancel all reservations and services made on behalf of the consumer after 24 hours. In such cancelations, no refund will be made to the consumer.

In the event that unforeseen circumstances or force majeure arise during the continuation of the tour, the relevant information and documents must be submitted to hammammia.com immediately upon the consumer's departure from the tour. hammammia.com has the right to cancel all reservations and services made on behalf of the consumer after 24 hours if the consumer does not notify in writing that he / she will participate in the tour / accommodation / service that he / she missed the start. In such cancelations, no refund will be made to the consumer.
